Before you read on

These Terms explain what you can expect from Breathe Sculpt Flow and what I need from you in return. They cover everything sold or hosted here: the BSF Membership, digital products and courses, 1:1 coaching, and in-person retreats and events.

I have written them in plain English on purpose. Where a legal term matters, I have used it and explained it. Nothing here takes away rights you have under German or EU consumer law.

1. Who you are contracting with

These services are provided by:

In accordance with § 19 UStG, no VAT is charged on these services.

Full legal and contact details are also set out in the Impressum, which is a separate page on this website and is required by German law.

2. What these Terms apply to

These Terms apply to www.breathesculptflow.com and to everything sold through it. They apply whenever you:

  • Buy or subscribe to the BSF Membership

  • Buy a digital product, course, or programme, including Move with Ease and Reset, Rebuild & Rise

  • Book a 1:1 session, including The Reset Session or a coaching package

  • Book a place at a retreat, workshop, or other in-person event

  • Use this website, or take part in the BSF community hosted on Circle

If you are buying as a business rather than as a private individual, some sections apply differently. Those differences are noted where they arise.

3. How a contract between us is formed

Displaying an offer on this website is an invitation for you to make an order, not a binding offer from me. A contract is formed when you complete checkout and I confirm your order by email. If I cannot fulfil an order, I will tell you and refund anything you have paid.

Before you complete checkout you will be shown the essential details of what you are buying, the total price, and the payment terms. Please check them. Any input errors can be corrected using the back button or the edit function in the checkout before you confirm.

The language of the contract is English.

4. Prices and payment

All prices are shown in euros. As a small business under § 19 UStG, I do not charge VAT, so the price you see is the price you pay. No VAT is shown separately on your invoice.

Payment is taken at checkout through my payment providers. I do not see or store your full card details. Depending on what you are buying, checkout is handled by Circle, PayPal, or Stripe, and their own terms and privacy notices apply to the payment itself.

Where a payment plan is offered, each instalment is due on the dates shown at checkout. If an instalment fails, I will contact you and may pause your access until payment is resolved. You remain responsible for the full agreed amount.

If a payment is returned unpaid, I may charge the actual bank charges I incur, unless the failure was not your fault.

5. The BSF Membership

5.1 What the membership includes

The membership gives you access to the BSF community and to the live classes, recordings, library content, and community spaces described on the sales page at the time you join.

The membership is a living thing. Class times, themes, and the content library will change and grow over time. I may adjust the schedule, add or retire content, or change the community spaces, as long as the overall value of what you receive stays broadly the same. If I make a significant change that reduces what you get, I will tell you in advance and you may cancel with effect from that change.

Move with Ease is a separate paid programme and is not a membership inclusion.

5.2 Monthly membership

A monthly membership runs from month to month and renews automatically. Your payment method is charged on the same date each month until you cancel, and each payment buys the month ahead.

There is no minimum term and no notice period. You can cancel at any time, and your access continues to the end of the month you have already paid for. Months that have already started are not refunded on a pro rata basis.

5.3 Annual membership

An annual membership has a minimum term of twelve months, paid up front. At the end of those twelve months it continues automatically on an open-ended basis, and you may cancel at any time with one month’s notice.

I will remind you by email before your annual membership renews so the charge never comes as a surprise.

5.4 Automatic renewal in short

Both membership options renew automatically. Monthly renews every month with no minimum term. Annual runs for twelve months, then continues month to month with one month’s notice to cancel. You will always be told the renewal terms at checkout before you pay, and you can cancel either option yourself at any time.

5.5 Founding member pricing

If you joined during the founding member window, your price is locked for as long as your membership stays active and uninterrupted. If you cancel and later rejoin, you rejoin at the standard price in effect at that time.

5.6 How to cancel

You can cancel your membership at any time using the cancellation button in your account, or by emailing me at hello@breathesculptflow.com . A cancellation by email is effective from the date I receive it.

5.7 If I end the membership

I may end your membership with one month’s notice. I may end it immediately if you seriously or repeatedly breach the community guidelines, or if you use the community in a way that harms other members. If I end your membership immediately for that reason, I will refund the unused portion of any payment you have made in advance.

6. Digital products, courses, and programmes

When you buy a digital product or course, you get a personal, non-transferable right to access and use it for your own private purposes. Access is provided for the period stated on the sales page, or for as long as the product remains available, whichever is stated.

You may not share your login, download and redistribute the material, resell it, or use it to teach or train others. Each purchase is for one person.

I may update or improve course content. If a programme has a defined start date and cohort, the dates shown at checkout apply.

If a product is withdrawn permanently and you have lifetime access, I will give you reasonable notice and the opportunity to download any downloadable material first.

7. 1:1 sessions and coaching

Sessions are delivered online in English unless agreed otherwise, at times booked between us.

If you need to reschedule, please give at least 24 hours’ notice and we will find a new time. Sessions cancelled with less notice, and sessions you do not attend, count as used. I understand that life with small children is unpredictable, and I will always try to be flexible where I reasonably can.

If I need to cancel or reschedule, I will offer you an alternative time or refund that session.

Coaching packages must be used within the period stated at purchase. Unused sessions expire at the end of that period unless we agree otherwise in writing.

8. Retreats, workshops, and in-person events

A place at a retreat or event is confirmed once I have received your deposit or full payment, and places are limited.

Accommodation is not included in the price of a retreat unless the booking page expressly says so. Where a hotel offers a rate to participants, you book and contract with the hotel directly. Travel to and from the venue is your responsibility.

Deposits are non-refundable, because your place is held and venue costs are committed in advance. This does not affect your statutory withdrawal right described in section 9.

If you cancel after the withdrawal period has ended:

  • More than 8 weeks before the event: the balance beyond your deposit is refunded

  • Between 2 and 8 weeks before: 90% of the total is refunded

  • Less than 2 weeks before: no refund, but you may transfer your place to another woman if you let me know in advance

If I have to cancel an event, you will receive a full refund. I am not able to reimburse travel or accommodation you have booked separately, so travel insurance is a sensible idea.

You take part in physical activity at retreats and events at your own risk, and section 12 applies.

9. Your right to cancel (right of withdrawal)

If you are a consumer in the EU, you normally have fourteen days to withdraw from a contract made online, without giving a reason. The period starts on the day the contract is made for services and digital content, and on the day you receive the goods for physical items.

To withdraw, tell me clearly that you wish to do so, by email to hello@breathesculptflow.com or using the model withdrawal form at the end of these Terms. Sending your message before the fourteen days are up is enough.

If you withdraw, I will refund all payments received within fourteen days, using the same payment method you used.

9.1 Digital content — important

If you want immediate access to digital content, you must confirm at checkout that you ask for it to be made available straight away and that you understand you lose your right of withdrawal once access has been given. If you do not confirm this, access will begin after the fourteen day period.

9.2 Services you have asked me to start early

If you ask me to begin a service during the withdrawal period and then withdraw, you pay a proportionate amount for what has already been delivered.

9.3 Events on a specific date

Under § 312g Abs. 2 Nr. 9 BGB, there is no right of withdrawal for leisure services provided on a specific date or within a specific period. This applies to retreats, workshops, and live events with a set date. The cancellation terms in section 8 apply instead.

10. Community rules

The BSF community is hosted on Circle. To take part you must also accept Circle’s own terms.

Our community guidelines form part of these Terms. In short: lead with kindness, protect each other’s privacy, do not sell or recruit inside the community, and do not share another member’s story outside the space.

I may remove content or suspend access if the guidelines are breached. For serious or repeated breaches, section 5.7 applies.

You are responsible for keeping your login details to yourself. Accounts are for one person and may not be shared.

11. Intellectual property

Breathe Sculpt Flow and the BSF Method, together with all classes, recordings, written material, sequences, and course content, belong to me, Melissa Schuler, and are protected by copyright.

You may use them for your own personal practice. You may not record, screenshot, download where downloads are not offered, republish, or share them, and you may not use them to teach others or to train any machine learning or AI system.

If you post content in the community, you keep ownership of it. You give me permission to display it inside the community. If I ever want to use something you have written outside the community, for example as a testimonial, I will ask you first.

12. Health, safety, and what this is not

This matters more than anything else on this page, so please read it.

Breathe Sculpt Flow offers movement, breathwork, and wellbeing education. It is not medical care, physiotherapy, midwifery care, psychological therapy, or a diagnosis of any kind, and it does not replace any of them. I am a yoga and movement coach, not a medical professional.

Before starting, and particularly if you are pregnant, recently postpartum, recovering from surgery, or living with any medical condition, please get clearance from your doctor, midwife, or other qualified professional.

You are responsible for:

  • Telling me about relevant health conditions, symptoms, injuries, or complications, and keeping me updated if they change

  • Practising in a safe space with enough room and suitable equipment

  • Working at a level that is right for your body on the day, and stopping if something hurts

  • Seeking medical help if you experience pain, bleeding, dizziness, or any symptom that concerns you

You take part at your own risk. In live online sessions I can only see what the camera shows me, and I cannot assess your alignment the way I could in person.

Nothing shared in the community by me or by other members is medical advice. If you are struggling with your mental health, please reach out to a qualified professional alongside anything you do here.

13. Liability

I am fully liable for damage caused intentionally or by gross negligence, and for injury to life, body, or health.

For slight negligence, I am liable only where an obligation essential to the purpose of the contract is breached, and then only for foreseeable damage typical of this kind of contract.

Liability under the German Product Liability Act is unaffected.

Beyond this, liability is excluded.

14. Availability and technical matters

I aim to keep everything running smoothly, but I cannot promise uninterrupted access. Circle, Zoom, and other platforms occasionally have outages that are outside my control.

If a live session cannot go ahead for technical reasons, I will reschedule it or provide a recording.

You need a reasonably current device and a stable internet connection. Meeting those requirements is your responsibility.

15. Third-party services

Parts of what I offer are delivered through other companies, including Circle, ThriveCart, Stripe, Flodesk, and Zoom. Their terms and privacy notices apply to their part of the service. I choose them carefully but I am not responsible for how they operate.

16. Data protection

How I handle your personal data is explained in the Privacy Policy, which is a separate page on this website.

17. Changes to these Terms

I may update these Terms, for example when I add a new offer or when the law changes. For one-off purchases, the version in force when you buy is the version that applies.

For ongoing contracts such as the membership, I will give you at least six weeks’ notice by email of any material change. If you do not agree, you may cancel with effect from the date the change takes effect. If you do not object before then, the change is treated as accepted, and I will say so clearly in the notice.

18. Governing law and disputes

German law applies. If you are a consumer, this does not remove the protection of any mandatory rules of the country you live in.

If you are a business, a public body, or have no general place of jurisdiction in Germany, the courts of Hamburg have jurisdiction.

I am not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.

19. If part of these Terms does not hold

If any part of these Terms turns out to be invalid, the rest stays in force.
